Visa H-2A

The H-2A visa is a United States program enabling agricultural employers to bring foreign workers for temporary or seasonal agricultural jobs. This visa is used when there are not enough domestic workers available. The program includes provisions to protect both U.S. and foreign workers' wages and working conditions, and it has a robust application and certification process for employers, with recent regulations focusing on enhancing worker protections and program integrity.

TRANSPORTATION

Employers under the H-2A program are obligated to cover, reimburse, or pay all travel expenses for their non-local employees, both from the U.S. and abroad. This encompasses expenses for incoming and outgoing journeys, including meals, lodging during travel, and visa costs for foreign workers, which must be reimbursed within the first week of work. H2A offers comprehensive guidance on travel reimbursements.

RECRUITMENT

H-2A employers must actively seek local U.S. workers for the job by advertising online and within their business premises, reaching out to previously laid-off U.S. employees, and considering referrals from the local State Workforce Agency (SWA). H2A ensures compliance with all U.S. recruitment regulations and requirements.


WAGE & WORK HOURS

H-2A employers are required to provide full-time employment (at least 35 hours per week) throughout the H-2A contract term, with wages set by the government based on the job type. They must also guarantee a minimum of 75% of the stipulated work hours for the duration of the contract. másH2A provides assistance in understanding and meeting all wage-related requirements.

HOUSING

H-2A employers are required to provide free accommodation to all non-local workers, including those from the U.S. and other countries. The housing provided must undergo an annual inspection and receive approval from the State Workforce Agency (SWA) or another authorized housing body.
